Terms of Use

These Terms of Use govern your use of the GymXP mobile application ("the App"), operated by Nicholas Hall, a sole trader based in the United Kingdom ("we", "us", "our"). By downloading or using the App you agree to these terms.

1. The App

GymXP is a fitness tracking application that provides workout logging, XP and progression tracking, nutrition logging, AI coaching, and related features. Access to all features requires an active GymXP Pro subscription.

2. Subscriptions

GymXP Pro is available as a monthly or annual auto-renewing subscription.
A 7-day free trial is available to new subscribers. You will not be charged during the trial period.
Payment is charged to your Apple ID account at confirmation of purchase or, if a trial is offered, at the end of the free trial period.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
You can manage and cancel your subscription at any time in your Apple ID account settings (Settings → Apple ID → Subscriptions).
No refunds are provided for unused portions of a subscription period, except where required by applicable law.
Any unused portion of a free trial will be forfeited upon purchasing a subscription.

3. Account

You may sign in with Apple or Google. You are responsible for maintaining the security of your account. You must not share your account credentials or allow others to access your account.

4. Acceptable Use

You agree not to:

Use the App for any unlawful purpose.
Attempt to reverse-engineer, decompile, or extract source code from the App.
Use the App in any way that could damage, disable, or impair our servers or networks.
Attempt to gain unauthorised access to any part of the App or its related systems.

5. Health Disclaimer

GymXP is a fitness tracking tool and is not a medical device. The AI coach provides general fitness guidance only and is not a substitute for professional medical or fitness advice. Always consult a qualified professional before starting a new exercise programme, particularly if you have any health conditions or injuries. We are not responsible for any injury or harm resulting from use of the App.

6. Intellectual Property

All content within the App, including but not limited to software, design, text, and graphics, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the App if you breach these terms. You may stop using the App at any time by cancelling your subscription and deleting the App.

9. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes within the App. Continued use of the App after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
